Terms & Conditions applicable to Participants in the  FIFA World Cup™ Campaign.

These Terms and Conditions are subject to the Terms and Conditions for Account Registration available at www.mycoke.com.mt/mcls/termsandconditions and the Privacy Policy available at www.mycoke.com.mt/mcls/privacypolicy   In case of inconsistencies between these Terms and Conditions and the Terms and Conditions for Account Registration or the Privacy Policy, these Terms and Conditions shall prevail.

 

A. The FIFA World Cup Campaign

Participants may take part in the FIFA World Cup ™ Campaign (the " Campaign ") being organised by The General Soft Drinks Company Ltd (the " Organise r") by purchasing promotional Coca-Cola® branded PET products (specified under section E below) (the “ Exclusive Products ”) containing a unique 8 digit code (the ‘’ Code ’’) located on the underside of the bottle cap, subject to acceptance of these Terms and Conditions. 

 

B. Duration of Campaign

The Campaign shall commence on 1st March, 2018 and shall end on 7th   May, 2018, both dates included (the " Campaign Period "). The Organiser reserves the right to cancel, shorten, extend, terminate and/or suspend the Campaign Period or otherwise modify or cancel the Campaign at its discretion and at any time.

 

C. The Campaign Prizes

Participants who find a unique 8 digit code located on the underside of the bottle cap of an Exclusive Product, shall be eligible to participate in the draw to win a free trip and accommodation (the “ Campaign Prizes ”) to the FIFA World Cup™ Matches to be held in Russia in 2018:

 

1. GRAND PRIZE:

FIFA World Cup™ HOSPITALITY PACKAGE

Date: 8th to 12th July 2018

ONE PRIZE AVAILABLE

This package includes:

a. Two Tickets for the winner and one guest to the Semi Final Match on the 11th July 2018 in       Moscow, Russia

b. Two Return Flight Tickets to Moscow, Russia

c. Accommodation at the 5 Star Metropol Hotel

c. All Meals and beer/wine at the exclusive Coca-Cola Hospitality Lounge

d. Entertainment at the exclusive Coca-Cola Hospitality Lounge

e. Coca-Cola sponsored leisure activities & branded gift items as determined by the Organiser

e. Transportation (Airport to Hotel / Hotel to Airport + To/From Match)

* All other expenses   such as, other transportation, additional luggage, other Meals & Drinks which are not in Hospitality lounge, hotel mini bar drinks, laundry, phone calls, and other personal entertainment are not included and must be borne by the Winner.

**Application and payment for Visa application to Russia must be borne by the winner.

*** Travel insurance cost will be borne by the Winner.

 

2. SECONDARY PRIZES:

A. FIFA WORLD CUP ™ SERBIA VS BRAZIL MATCH 27th June 2018

This package includes:

a. Two Tickets for the winner and one guest to the SERBIA VS BRAZIL MATCH in Moscow, Russia

b. Two Return Flight Tickets to Moscow, Russia

c. Accommodation at a 3* Hotel as determined by the Organiser

 

B. FIFA WORLD CUP ™ QUARTER FINAL MATCH 6th July 2018

THREE SETS OF PRIZES AVAILABLE

This package includes:

a. Two Tickets for the winner and one guest to the Quarter Final Match in Kazan, Russia

b. Two Return Flight Tickets to Kazan, Russia

c. Accommodation at a 3* Hotel as determined by the Organiser

 

* All other expenses such as, other transportation, additional luggage, hotel mini bar drinks, laundry, phone calls, and other personal entertainment are not included and must be borne by the Winner.

**Application and payment for Visa application to Russia must be borne by the winner.

*** Travel insurance cost will be borne by the Winner.

 

D. Eligibility and Participation

1.        Subject to these Terms and Conditions, the Campaign is open to any Participant who is over eighteen (18) years of age and has opened an account with the Organiser by registering an account at www.mycoke.com.mt/mcls/register). Corporations, associations and/or other legal persons, employees of the Organiser and/or any related company shall not be eligible to participate in the Campaign

 

 

E. Exclusive Products

1.   Codes  shall be located on the underside of the bottle cap of the following Coca-Cola® branded Exclusive Products, bottled and supplied locally by the Organiser  -  Coca-Cola  (0.5 litre and 1.5 litre PET bottles),  Coca-Cola Zero  (0.5 litre and 1.5 litre PET bottles) and  Diet Coca-Cola  (0.5 litre and 1.5 litre PET bottles) .

2.   Exclusive Products must have the promotional label in order to be eligible for the Campaign. The Organiser may add or remove Coca-Cola® branded products, at its sole discretion during the Campaign.

 

 

F. Codes

1.        Participants who find the Code located on the u nderside of the bottle cap of an Exclusive Product shall be required to create an account on: www.mycoke.com.mt/giftscampaign (the “Account”) free of charge or log into their existing account (for those who have already participated in the mycoke points loyalty scheme or the national gifts campaign) and input the Code located on the Exclusive Product during the Campaign Period. After inputting the Code, the Participant will be required to click on the ‘Submit Code’ button.

2.        Participants must accept these Terms and Conditions and consent to the processing of their personal data, including for marketing purposes as outlined in these Terms and Conditions, by clicking “I accept”. Failure to click “I accept” either for being bound by these Terms and Conditions and/or for the processing of the Participant’s personal data prevents the Participant from participating in the Campaign.

3.        Participants may log in at any time however during the Campaign Period and input more than one (1) Code.   All Codes will be accumulated onto the Participant’s Account.

4.        All Codes shall be automatically recorded into the Campaign database.

5.        All bottle caps of inputted Codes must be kept by the Participant. The winners of the Campaign Prizes shall be requested to submit the cap with the chosen Code. Failing to do so may result in the forfeit of the Campaign Prizes.

6.        Each Code may only be inputted once. A Participant may not input more than ten (10) Codes during any twenty-four (24) hour period. Entry by a Participant of twenty (20) invalid codes during any twenty-four (24) hour period, may, at the discretion of the Organiser, lead to disqualification of the Participant from the Campaign.

7.        Each Participant shall only be entitled to one (1) Account and shall not accumulate or transfer codes with or into other Participants’ Accounts or transfer, sell or otherwise dispose of codes in any other manner which is in violation or attempted subversion of these Terms and Conditions and/or the Campaign. If the Organiser believes that a Participant is in violation of this section, the Organiser may disqualify the Participant from the Campaign and all Codes in the Participant’s Account shall be forfeited.

8.        Once a Participant inputs the Code, the validation of the Code will be subject to instant verification. Codes are void if (a) not obtained in accordance with these Terms and Conditions and/or through legitimate channels or (b) any part of the Code or the packaging on which it is printed is counterfeit, altered, defective, tampered with or irregular in any way.

9.        If a Participant believes that Codes were not properly accrued to his/her Account, the Participant must notify the Organiser within fifteen (15) days from the date of entry of the respective Code on the Website. Should this case arise, caps must be presented as proof.

10.    The Organiser reserves the right to require proof, including, but not limited to, the Exclusive Product packaging (bottle cap). Validated Codes that are subsequently determined to be invalid for any reason are subject to disqualification and the corresponding Codes will be removed from the Participant’s Account to which the invalid and/or validated Codes were accumulated.

11.    Codes entered for this Campaign shall be automatically erased from the Participant’s Account thirty (30) days after the Campaign Period.

 

 

G. Grand Prize & Prizes Draw

1.        All Participants who have entered a Code onto their Account on the Website at least once during the Campaign Period will automatically participate in the Campaign Prizes draw. The Organiser shall randomly select one (1) winner for each of the Secondary Prizes and one (1) winner for the Grand Prize (Hospitality Package).

2.        Every drawn winner/s shall be asked a skill question and upon answering correctly will be awarded the respective prize.

3.        The draw for the Serbia vs Brazil match will be held on the 17th May 2018.

4.        The draw for the three sets of quarter final prizes will be held on the 17th and 18th May 2018.

5.        The Grand Prize (Hospitality Package) will be held on the 21st May 2018.

6.        All draws shall take place in the presence of a notary.

7.        The Organiser reserves the right to change the dates of the draws. 

8.        A video of the draws will be available for public viewing and will also be published on the Organizers Social platform.

9.        The winner will be contacted via email and/or mobile number supplied on the Account. It is the Participant’s responsibility to provide the correct and valid details. Each Participant shall be responsible for ensuring the accuracy of his/her Account and is encouraged to check his/her Account regularly. Participants who opt to use the account already registered for the mycoke loyalty scheme must ensure all details are correct and updated. The Organiser reserves the right to draw and select another winner, should the first draw winner/s not be reached within a maximum of twenty-four (24) hours .

10.    The Campaign Prize winners shall be presented with the respective prize upon presentation of a valid identification document together with a letter from the Organiser confirming that s/he is the Campaign Prize winner/s.

11.    The winner/s will be asked and must submit personal information including identification details, passport details and photos of both the winner and their guest by no later than three (3) days after they have been presented with the prize.

12.    The winner/s must apply and undergo payment for a Visa to Russia upon their own accord and must ensure that the said Visa for both winner and guest will be available upon their departure. Failure to apply and achieve Visa will result in the prize being forfeited.

13.    The Winner (and their guest) must also ensure that their passport is valid for a minimum of six (6) months.

14.    No changes may be made to the prize offered by the Organiser.

15.    The Campaign Prizes cannot be redeemed in cash or any other offer.

16.    The Organiser shall not be liable for or be obliged to replace any lost or stolen Campaign Prizes.

H. Modifications and Termination of the Campaign

1.        The Organiser reserves the right to modify any of the Terms and Conditions set forth herein including but not limited to - the duration of the Campaign Period ; the Exclusive Products which contain the Codes; methods by which Participants can find Codes; and any of the options made available to Participants with respect to their Accounts; at any time, with or without notice, even though these changes may affect a Participant’s ability to participate in the Campaign.

2.        A Participant’s participation in the Campaign constitutes the Participant’s acceptance to these Terms and Conditions as may be amended from time to time. Participants are responsible for keeping up to date with any changes that the Organiser may have made to these Terms and Conditions. The most current version of the Terms and Conditions will be made available on the Website and will supersede all previous versions of these Terms and Conditions. 

3.        For the avoidance of doubt, any cancellation, revision, termination or suspension by the Organiser of the Campaign shall not entitle any Participant to any claim or compensation against the Organiser for any and all loss or damage suffered or incurred by any Participant as a direct or indirect result of the act of cancellation, revision, termination or suspension.

 

I. Miscellaneous

1.        The Organiser reserves the right to discontinue the participation privileges of any Participant who engages in any improper activity or uses the Campaign in a manner inconsistent with these Terms and Conditions or any national law statutes or ordinances. Termination of participation privileges may result in the loss of accumulated Codes. In addition to termination of participation privileges, the Organiser shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.

2.        Codes may be revoked at any time by the Organiser at its sole discretion.

3.        The Organiser’s decision on all matters relating to the Campaign will be final and binding.

4.        The Organiser shall not be responsible for any incorrect or inaccurate information supplied by the Participants during the Campaign.

5.        The Organiser shall not be responsible for incorrect or inaccurate transcription of information related to any of the equipment or programming associated with the Campaign or utilized by the Organiser, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the Website or online service or for any other technical or non-technical error or malfunction.

6.        The Organiser and its respective related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Campaign or the production or distribution of Campaign materials ('Releases') shall not be held responsible or liable in the event of a printing error or irregular packaging.

7.        Under no circumstances, including but not limited to negligence, shall the Organiser, its officers, representatives and/or employees be liable for any direct, indirect, incidental, special or consequential damages arising out of the Campaign or merchandise offered through the Campaign, even if any or all of the foregoing or any of their authorized representatives have been advised of the possibility of such damages. 

8.        The Organiser, its joint ventures, officers, directors, employees, shareholders, promotion agencies, agents, successors, assignee, and service providers, shall not be responsible for any products or services offered by the suppliers of the Campaign Prizes.

9.        To the fullest extent permitted by law, by participating in this Campaign, each and every Participant is agreeing that he/she will not hold the Organiser and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that the Organiser may engage for the purposes of this Campaign), liable for any loss or damages that he/she may incur, in connection with the Campaign.

10.    The Organiser reserves the right as it deems fit to vary or change any of these Terms and Conditions with notice. These Terms and Conditions may be varied or changed by the Organiser by way of posting on [www.mycoke.com.mt Webpage or in any other manner deemed suitable by the Organiser. Participants are deemed to have accessed [www.mycoke.com.mt-] Website and to have knowledge of and to have agreed to any changes or variations to these Terms and Conditions. Participants agree that their continued participation in the Campaign will constitute their acceptance of these Terms and Conditions (as varied or changed).

11.    All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms and Conditions, or the rights and obligations of the Participant and the Organiser in connection with Campaign, shall be governed by, and construed in accordance with, the Laws of Malta without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Malta.

12.    These Terms and Conditions constitute the entire agreement between the Participants and the Organiser pertaining to the subject matter herein and supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.

13.    Collection of any Campaign Prize may be subject to acceptance of other terms, conditions or policies in the Organiser’s discretion.

14.    If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
